THE CONSTITUTIONAL COURT UPHOLDS NKANDU LUO’S ELECTION

The Constitutional Court has reversed the decision of the High Court that nullified the election of Professor Nkandu Luo as Member of Parliament for Munali.

 

Prof Luo’s seat was nullified by High Court Judge Edward Musona upon being satisfied with the evidence adduced by the UPND which accused Munali lawmaker of using government resources to campaign and sponsoring cadres to attack the opposition members among others which in turn affected the outcome of the elections.

 

But in passing his judgment, Constitution court judge Enock Mulembe said the lower court misdirected itself at law when it nullified Professor Luo’s seat because there is no evidence to directly link the Munali Member of Parliament to the alleged electoral malpractice.
